Checked against the legal texts on 4 November 2026. Article 13.4 of 115-FZ has been repealed; the current basis is article 13(4). This guide does not replace advice on your individual status.
Who can work without a patent
Three cases under 115-FZ art. 13(4): (1) full-time students of accredited college, bachelor’s, specialist, master’s, residency, assistantship and postgraduate programmes, for any employer, in time free from study (sub-para 7.1); (2) any student of a college, university or research organisation during holidays (sub-para 6); (3) students working at their own university in free time (sub-para 7). Colleges count here, unlike for RVPO.
Preparatory-faculty and part-time students can work without a patent only during holidays or at their own university. There is no fixed weekly hour cap like the EU’s 20 hours — the condition is “time free from study”, so shifts that clash with classes are a risk. During holidays full-time work is allowed under general Labour Code limits. With RVPO you may work only in the region that issued it.

Documents for the employer
Passport (with notarised translation if not in Russian), migration card and registration notice, university certificate of full-time study, SNILS, and RVPO if you have one. There is no single form or validity for the certificate; HR usually asks for a new one each term with study form, holiday dates and timetable. Health insurance (DMS) is required for employment only from highly qualified specialists.
SNILS: get it yourself at a Social Fund office or MFC (issued the same day at the Fund), or the employer files form ADV-1 the next working day and SNILS arrives within five working days. INN: form 2-2-Uchet at any tax office, MFC, by post or online; since 1 January 2026 a paper INN certificate is no longer issued — an extract from the register confirms it. Both are free.

What the employer must do
The employer or client under a civil contract must notify the MVD of the start and end of the contract within three working days (115-FZ art. 13(8)). Fines for failing to notify from 3 November 2026 (Administrative Code art. 18.15): legal entities 400,000–800,000 roubles or suspension for 14–90 days; in Moscow, St Petersburg and their regions 400,000 roubles to 1 million. If HR says “you need a patent”, show sub-para 7.1 of art. 13(4) and the study certificate; do not cite the repealed art. 13.4.
The law does not oblige you to tell the employer you were expelled, but the right to work ends with student status and the employer risks a fine — so warn them. For RVPO holders the contract ends on cancellation or expiry of the permit (Labour Code art. 327.6); for others the employer suspends under art. 327.5 and then dismisses.

Employment contract, civil contract, self-employment
An employment contract gives sick pay, leave and social contributions; part-time hours set in the contract fit around classes most easily. A civil (service) contract is also allowed, with the same 3-day MVD notice. Self-employment (NPD) is open only to citizens of Russia, the EAEU (Belarus, Kazakhstan, Armenia, Kyrgyzstan) and, per Tax Service guidance, Ukraine. It depends on citizenship, not visa or RVPO — students from Africa, Asia outside the EAEU or Latin America cannot register. Delivery apps that onboard couriers as self-employed are therefore closed to them; an employment contract via an agency is possible.

Income tax: 30% then 13%
Until you are a tax resident, salary is taxed at 30%. You become resident after at least 183 days in Russia within 12 consecutive months; residents pay 13% on income up to 2.4 million roubles a year (higher rates above). EAEU citizens pay resident rates from day one. Once residency is final for the year, the employer recalculates and offsets the overpayment; if the employer has changed, file a 3-NDFL return after the year ends.
Fines, fake “paperwork fees” and money mules
Working without the right to work, from 3 November 2026: 4,000–7,000 roubles with or without expulsion; in Moscow, St Petersburg and their regions 7,000–9,000 roubles with mandatory expulsion (Administrative Code art. 18.10). Nobody should charge you to be hired: the employer files the MVD notice, SNILS and INN are free. A request for a “prepayment for paperwork” is a scam sign.
Handing over your bank card, online-banking access or carrying out transfers on someone’s instructions for a reward is a crime since 2025 (Criminal Code art. 187, parts 3–6): up to three years’ imprisonment, up to six years and a fine of up to 500,000 roubles if for gain or in a group. For a foreigner this practically guarantees loss of status, expulsion and an entry ban.

“Work should fit around classes, not the other way round. Timetable and exams first, then shifts: evenings, weekends, holidays. Academic debt costs more than any salary: expulsion means losing the right to work, the visa or RVPO. And not one day without a contract and an MVD notice — a 7,000–9,000 rouble fine is nothing next to expulsion and an entry ban.” — Vlad, TwoNations
Common questions from foreign students
Can I work as a courier without an EAEU passport?
Not as self-employed. Under an employment or civil contract, yes — if you study full-time, work outside class time and the employer notifies the MVD.
Will my dean’s office find out I work?
The law does not require the employer to inform the university. It learns only if you ask for a certificate for the employer.
I am at a preparatory faculty. Can I work?
Only during holidays or at your own university. An outside job during term without a patent is an offence under art. 18.10.
